Illinois has the strictest biometric privacy law in the United States. BIPA requires written consent and a public retention policy before any business collects fingerprints, face geometry or similar identifiers, and it gives individuals the right to sue directly. That matters for loyalty programs because some systems identify customers by face or fingerprint. Sopoints does not. It identifies customers by phone number, QR code or NFC tap, and never by biometrics - no facial recognition, no fingerprint scanners, nothing BIPA covers.
